1. Identification of the website operator
The SMART-HR.WORLD website (the "Site") is owned and operated by S.C. JOBLEE S.R.L. ("JOBLEE", the "Company", "we"), a Romanian legal entity with its registered office in Ilfov County, Șos. Lipia Nuci no. 12, Room 2, Lipia Village, Gruiu Commune, registered with the Trade Register under no. J23/302/2022, having Unique Registration Code (CUI) RO 45492027.
Through the Site, JOBLEE operates two related sets of services: "SMART HR Event" (the sale of tickets, subscriptions and vouchers for events, described in Sections 5-7) and "SMART HR Community" (the membership community described in Section 8).

2. Definitions
"User" – any person who accesses or uses the Site, whether or not registered.
"Services" – collectively, SMART HR Event and SMART HR Community, and all services made available through the Site (information, event registration, purchase of tickets/subscriptions/vouchers, Community membership, applying to listed jobs, etc.).
"Event" – events organised by JOBLEE or its partners, indoor or outdoor, promoted through the Site as part of SMART HR Event.
"Partner" – employers, sponsors or other entities participating in Events.
"Community" – the "SMART HR Community" membership community made available through the Site, as described in Section 8.
"Member" – a User who has registered for and holds an active Community membership.
"Membership Fee" – the recurring fee payable by a Member for access to the Community, as set out on the Site at the time of registration.
"Consumer" – a User who is a natural person acting for purposes outside their trade, business, craft or profession, as defined by Government Emergency Ordinance No. 34/2014.
3. Acceptance of the Terms and Conditions
Use of the Site and the Services is conditional upon acceptance of these Terms and Conditions. By checking the box "I accept the Terms and Conditions" or, where applicable, by simply using the Site, the User confirms that they have read, understood and agreed to these provisions.
Any additional or different conditions that the User may wish to impose will not be recognised by JOBLEE unless expressly accepted in writing by JOBLEE.
These Terms and Conditions are supplemented by the provisions of the Privacy Policy and, where applicable, the Cookie Policy, available on the Site.
4. Permitted use of the Site
The User is authorized to access and view the content of the Site, and to make a copy of its pages, exclusively for personal, non-commercial use — for example, to view information about Events or the Community, or to purchase tickets or a Community membership for their own use.
It is prohibited to reproduce, download, publish, modify, distribute or otherwise use the content of the Site for any other purpose without JOBLEE's prior written consent, except for the uses expressly permitted under Section 13 (Intellectual Property Rights) below.
5. SMART HR Event — description of the ticketing services
Through the Site, JOBLEE offers for sale, under "SMART HR Event", tickets, subscriptions and vouchers for Events to registered or unregistered Users, in exchange for payment via online payment methods (bank card). This Section 5 and Sections 6-7 apply specifically to SMART HR Event; the SMART HR Community membership is governed by Section 8.
Tickets ordered and paid for through the Site will be sent to the User by e-mail within a maximum of 2 (two) business days from confirmation of payment.
JOBLEE reserves the right to restrict participation in Events by employers/Partners who fail to fulfil their contractual obligations towards JOBLEE.
Tickets will not be issued or handed over to persons who: (i) have not previously placed an order through SMART-HR.WORLD; (ii) cannot provide proof of payment; or (iii) have not correctly and completely filled in the details requested in the order/registration form.
For orders that do not contain the correct identification details of the person who placed the order, JOBLEE reserves the right to cancel that order, with prior notice to the User and, where applicable, reimbursement of any amounts already paid.
JOBLEE reserves the right to limit, in an objective and non-discriminatory manner, the number of tickets that may be ordered per order and/or per person/delivery address, depending on the type of Event, as well as the right to cancel orders that reasonably indicate an intention to resell tickets.
6. Right of withdrawal — Event tickets
In accordance with Article 16(l) of Government Emergency Ordinance No. 34/2014 on consumer rights in contracts concluded with traders (which transposes Directive 2011/83/EU), contracts for the supply of services related to leisure activities which provide for a specific date or period of performance (such as event tickets) are exempt from the 14-calendar-day right of withdrawal generally applicable to distance contracts.
Accordingly, once issued and delivered, tickets valid for an Event taking place as announced (date, time, location and, where applicable, participants) cannot be returned, and their value will not be refunded, except in the situations set out in Section 7 below.
This exemption does not affect the Consumer's rights under applicable law in the event of non-conformity of the service provided or other breaches attributable to JOBLEE. The right of withdrawal applicable to the SMART HR Community membership is governed separately by Section 8.5.
7. Postponement, modification or cancellation of an Event. Ticket returns
In the event of postponement (change of date and/or time), a change of location, or a substantial change to the participants originally announced, or in the event of cancellation of an Event, JOBLEE will inform Users, by posting on the Site and/or by e-mail, of the conditions for returning tickets and recovering their value.
In the event of postponement of an Event, the User may choose to keep their order (valid for the new date) or to cancel it and receive a refund of the value of the tickets.
In the event of a return, JOBLEE will refund the value of the tickets. Additional costs not charged by JOBLEE (for example: shipping/courier costs, bank commissions and fees charged by payment service providers, ancillary services already rendered) will not be refunded, to the extent permitted by law.
Ticket returns or refunds will not be accepted for tickets that have been ordered, paid for, delivered and remain valid for an Event held as originally announced, where there has been no material change to the date, time, location or participants.
8. SMART HR Community — Membership
This Section 8 governs "SMART HR Community" (the "Community"), a professional membership community made available through the Site, offered by JOBLEE alongside SMART HR Event. Where this Section 8 conflicts with any other provision of these Terms and Conditions in relation to the Community, this Section 8 prevails.
8.1. Description of the Community
Access to the Community and its benefits — which may include, without limitation, networking with other professionals and employers, access to exclusive content and resources, participation in member-only discussions or groups, and preferential access to Events — is available to natural or legal persons who register as Members and pay the applicable Membership Fee, as described on the Site at the time of registration.
8.2. Eligibility and registration
To become a Member, a User must complete the registration process on the Site, provide accurate and complete information, and pay the Membership Fee corresponding to the membership plan selected. JOBLEE may, at its discretion and in a non-discriminatory manner, verify the information provided and may refuse or terminate a membership application where the information provided is false or incomplete, or where the applicant does not meet the eligibility criteria published on the Site.
8.3. Membership Fee and billing
The Membership Fee, the billing frequency (e.g. monthly or annual) and the accepted payment method (online payment by bank card or by bank transfer) are set out on the Site at the time of registration. JOBLEE may change the amount of the Membership Fee for future billing periods, provided that it notifies Members at least 30 days before the change takes effect; a Member who does not agree with the change may cancel the Membership before the change takes effect, in accordance with Section 8.6, without penalty.
8.4. Auto-renewal
Unless otherwise stated at the time of registration, the Membership is a recurring subscription that renews automatically at the end of each billing period, for a further period of the same duration, and the Membership Fee will be charged automatically to the payment method on file, unless the Member cancels the Membership in accordance with Section 8.6. JOBLEE will send a reminder notice by e-mail before each automatic renewal, in reasonable time for the Member to exercise the cancellation right described in Section 8.6.
8.5. Cancellation of Membership
A Member may cancel the automatic renewal of their Membership at any time, with effect from the end of the then-current billing period, by giving JOBLEE at least 30 days' notice before the renewal date, through the account settings on the Site or by contacting JOBLEE via the Contact page or the e-mail address indicated in Section 1. Cancellation does not entitle the Member to a refund of Membership Fees already paid for the current billing period, except as required by applicable law or as described in Section 8.5.
8.6. Suspension and termination of Membership
JOBLEE may suspend or terminate a Membership, in whole or in part, where the Member breaches these Terms and Conditions (including the conduct rules in Section 8.8), provides false information, fails to pay the Membership Fee when due, or engages in unlawful conduct through the Community. Except in cases of serious or repeated breaches, or where required by law or by order of a competent authority, JOBLEE will provide the Member with a statement of reasons and a reasonable opportunity to remedy the breach before suspension or termination, consistent with the transparency principles of Regulation (EU) 2022/2065 (the Digital Services Act).
8.7. Member conduct and Community content rules
When using the Community, Members must not: (a) post or share content that is unlawful, defamatory, discriminatory, harassing, or that infringes the rights of third parties (including intellectual property and personal data rights); (b) impersonate another person or misrepresent their professional affiliation or qualifications; (c) use the Community for unsolicited advertising, spam, or unauthorized commercial solicitation; or (d) attempt to circumvent the security or access-control features of the Site.
Members remain solely responsible for any content they post or share within the Community ("Community Content"). By posting Community Content, the Member grants JOBLEE a non-exclusive, royalty-free license to host, display and distribute that content solely for the purpose of operating and promoting the Community, for as long as the content remains posted. This license does not transfer ownership of the Community Content, which remains with the Member or the relevant rights holder.
8.8. Content moderation and complaints
JOBLEE may review, moderate, restrict or remove Community Content that breaches Section 8.8 or applicable law, and may act on notices received from Members or third parties regarding allegedly unlawful content. Members may submit complaints regarding moderation decisions or Community Content through the Contact page of the Site; JOBLEE will handle such complaints through an internal complaint-handling mechanism and will respond within a reasonable time.
9. Processing of personal data
This section is for information purposes, in accordance with Article 13 of Regulation (EU) 2016/679 (GDPR) and Law No. 190/2018. Complete information on the processing of personal data is available in the Privacy Policy published on the Site, which forms an integral part of these Terms and Conditions.
9.1. Data controller
S.C. JOBLEE S.R.L., with the identification details set out in Section 1.
9.2. Categories of data processed
To participate in Events, to register for and use the Community, and, where applicable, to apply to jobs listed on the Site, JOBLEE may process data such as: first name, last name, e-mail address, phone number, billing details for the Membership Fee, Community profile information and Community Content, as well as data on professional skills, knowledge and experience, provided directly by the User or Member.
9.3. Purposes and legal basis
Data is processed for the purposes of: (i) organising and running Events, including issuing and delivering tickets, and providing the Community membership, including billing the Membership Fee – legal basis: performance of a contract (Article 6(1)(b) GDPR); (ii) directing Users towards relevant opportunities, based on the needs of participating Partners – legal basis: the legitimate interest of JOBLEE and of the Partners (Article 6(1)(f) GDPR) or the User's consent, as applicable; (iii) running contests/activities held as part of Events (for example, the "Fun Plaza" area) – legal basis: performance of a contract or consent, as applicable; (iv) maintaining accounting and billing records for Membership Fees – legal basis: compliance with a legal obligation (Article 6(1)(c) GDPR), for the retention period required by applicable Romanian accounting and tax legislation.
9.4. Partners' access to data
Partners participating in an Event may access the personal data provided by the User through the registration form only to the extent that the User: applies to one of the jobs listed by that Partner; interacts with the Partner, including, where applicable, by scanning an assigned QR code; participates in contests organised as part of the Event; or purchases products distributed by the Partner at the Event venue.
9.5. Data retention period
Personal data shared with Partners may be processed and stored by them solely for recruitment and selection purposes, for a maximum period of 6 months from collection, unless a different period is required by law or the User withdraws their consent before that period expires. Community account and profile data is retained for as long as the Membership is active, and for a reasonable period thereafter to comply with legal, accounting or dispute-resolution requirements.
9.6. User and Member rights
As a data subject, the User or Member is entitled, under the conditions provided by law, to the right of access, rectification, erasure, restriction of processing, data portability, objection, and the right to withdraw consent at any time (without affecting the lawfulness of processing carried out before the withdrawal). These rights may be exercised by submitting a request via the Site's Contact page or at the e-mail address [dedicated data-protection contact e-mail to be completed].
9.7. Right to lodge a complaint
The User or Member has the right to lodge a complaint with the Romanian National Supervisory Authority for Personal Data Processing (ANSPDCP), headquartered at 28-30 G-ral. Gheorghe Magheru Blvd., Sector 1, Bucharest, e-mail: anspdcp@dataprotection.ro, website: www.dataprotection.ro, or with the competent court.
9.8. Privacy Policy
For further details on the rules for processing and storing personal data, including the use of cookies, please refer to the Privacy Policy available on SMART-HR.WORLD.
10. Complaints and dispute resolution
Any complaint regarding the Services purchased through the Site — including Event tickets and the Community membership — may be submitted via the Site's Contact page or at the e-mail address [dedicated contact e-mail to be completed].
The User-Consumer may also contact the Romanian National Authority for Consumer Protection (ANPC) – www.anpc.ro, as well as, for disputes concerning online purchases, the European Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr/.
These provisions do not affect the User's right to bring proceedings before the competent courts.
11. Disclaimer of warranties and limitation of liability
JOBLEE makes reasonable efforts to ensure the proper functioning of the Site and the Services (both SMART HR Event and SMART HR Community). To the extent permitted by applicable law, JOBLEE is not liable for: (i) temporary interruptions in the functioning of the Site or delays in transmitting information, caused by circumstances reasonably beyond its control (for example, technical failures of third parties or force majeure events); (ii) delays, postponements or cancellations of an Event caused by restrictions imposed by public authorities; (iii) Community Content posted by Members, subject to Section 8.9.
Nothing in this section excludes or limits JOBLEE's liability: (a) for death or personal injury caused by its fault; (b) in case of willful misconduct or gross negligence; or (c) in any other situation where the limitation or exclusion of liability would not be permitted under applicable consumer protection law, including Law No. 193/2000 on unfair terms in contracts concluded between traders and consumers.
JOBLEE is not liable for the content of third-party websites linked from the Site (including sponsor or Partner websites), which are governed by their own terms and policies. JOBLEE is also not liable for any attempts by third parties to resell tickets purchased through the Site; such unauthorized resale is prohibited and may result in the cancellation of the tickets concerned.
12. Accuracy and currency of information
JOBLEE makes reasonable efforts to ensure the accuracy and currency of the information published on the Site, without being able to guarantee the absence of any error. General information on the Site does not constitute advice of any kind, and its use is at the User's own risk. This does not affect any legal or contractual guarantees applicable to the Services purchased.
13. Intellectual property rights
All copyright, trademarks and other intellectual property rights in the texts, images and other materials on the Site belong to JOBLEE or are used with the right holder's consent, and are protected by Romanian law (including Law No. 8/1996 on copyright and related rights) and by European Union law. The license granted by Members over Community Content is governed separately by Section 8.8.
The User may browse the Site and reproduce, by printing or downloading, portions of it, exclusively for personal, non-commercial use, provided that all copyright and ownership notices remain unaltered. Reproduction for commercial purposes, modification, or incorporation of the Site's content into other works, publications or websites is prohibited without JOBLEE's prior written consent.
The trademarks, logos and other distinctive signs displayed on the Site, including "SMART HR Event" and "SMART HR Community", belong to JOBLEE S.R.L. Nothing in this document shall be construed as granting, implicitly or explicitly, any license or right to use these trademarks.
14. Amendments to the Terms and Conditions
JOBLEE reserves the right to periodically amend these Terms and Conditions, to reflect, among other things, legislative changes or changes to the Services offered. Any amendment will be published on the Site, indicating the date of the last update, and registered Users and Members will be informed by e-mail or through a notice displayed on the Site at least 15 days before material amendments take effect (this notice period is separate from, and does not replace, the 30-day notice required for Membership Fee changes under Section 8.3).
Continued use of the Site after amendments take effect constitutes acceptance of those amendments. Orders and Memberships in place before an amendment remain subject to the Terms and Conditions in force at the date the order was placed or the Membership was taken out, until their next renewal.
15. Restriction of access
The User is required to provide true, accurate and complete information whenever requested to do so. JOBLEE may restrict or suspend the access of any User who breaches these Terms and Conditions or applicable law, and may at any time decide to discontinue one or more of the Services offered through the Site, subject to rights already acquired by Users (for example, tickets already purchased and still valid, or Membership Fees already paid for the current billing period). Restriction or suspension of a Member's access to the Community specifically is governed by Section 8.7.
16. Governing law and final provisions
These Terms and Conditions are governed by Romanian law, subject to the mandatory consumer protection rules applicable in the EU Member State of residence of the User-Consumer, where applicable.
If any provision of these Terms and Conditions is declared invalid or unenforceable, the remaining provisions will continue to be valid.
Any disputes will be resolved amicably; failing an amicable resolution, disputes will be submitted to the competent courts in accordance with the law, without prejudice to the Consumer's right to contact the authorities or platforms referred to in Section 10.
