This Privacy Policy explains all aspects regarding the processing of personal data and ensures compliance with the principles relating to processing, as well as respect for your rights regarding this data, when you interact with us in connection with our products and services, in your capacity as a visitor, User or Member of our website. These aspects are established by the provisions of the European and national legislation in force, namely the General Data Protection Regulation (EU) 2016/679 (GDPR), Law No. 190/2018 on measures for implementing the GDPR, Law No. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, and any decisions issued by the National Supervisory Authority for Personal Data Processing (ANSPDCP) as the supervisory authority for personal data protection.
1. Who we are
S.C. JOBLEE S.R.L., headquartered in Ilfov County, Șos. Lipia Nuci no. 12, Room 2, Lipia Village, Gruiu Commune, registered with the Trade Register under no. J23/302/2022, CUI RO 45492027 (hereinafter referred to as the "Company", the "Operator" or "we"), organises events, operates a professional membership community, and markets related services via the SMART-HR.world portal (comprising "SMART HR Event" and "SMART HR Community", as described in our Terms and Conditions).
For any processing carried out wholly or partly by automated means, as well as processing by non-automated means of personal data forming part of, or intended to form part of, a filing system, we ensure that your data is:
Processed lawfully, fairly and transparently;
Collected for specified, explicit and legitimate purposes and not further processed in a manner incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research, or statistical purposes is not considered incompatible with the initial purposes;
Adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed;
Accurate and, where necessary, kept up to date; every reasonable step is taken to ensure that inaccurate personal data is erased or rectified without delay;
Kept in a form permitting identification of data subjects for no longer than necessary for the purposes for which it is processed, subject to the archiving/research/statistical exception mentioned above;
Processed in a manner ensuring appropriate security, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, through appropriate technical and organisational measures.
Our services are dynamic and we frequently introduce new features, which may require the collection of new information. If we collect materially different personal data, or make material changes to how we use data, we will notify you and update this Privacy Policy accordingly.
2. What are the categories of data subjects?
We process the personal data of different categories of data subjects, depending on the capacity in which they interact with the Company, always on a defined legal basis:
Visitors of SMART-HR.world — anonymous persons who only access and browse the portal;
Visitors of SMART-HR.world, "candidate" Users — who complete and register a user profile in order to participate in Events organised via the portal and apply to jobs made available by employers; who submit requests through one of the communication channels provided by the Company; or who subscribe to the newsletter;
Users of our website, "employer" Users — who build and register an employer profile in order to participate in Events organised via the portal and to publish jobs for the purpose of attracting candidates; who submit requests through one of the communication channels provided by the Company; or who subscribe to the newsletter;
Members of SMART HR Community — Users who register for and pay the recurring Membership Fee to access the Community and its benefits, as described in our Terms and Conditions;
Potential or actual business partners of the Company — persons who have the capacity of employee, collaborator, representative, or other contact person, or direct or indirect shareholder or beneficial owner, of a potential client/client, potential supplier/supplier, or other business partner of the Company.
3. For what purposes do we process your personal data?
The main purpose for which we process your personal data is to ensure that the contractual agreements between us can be properly implemented, so that our contractual relationships function smoothly and comply with legal requirements.
The Company processes personal data for the following purposes:
Providing access to and use of the SMART-HR.world portal services, by ensuring the proper functioning of the website;
Creating and administering the user account within the SMART-HR.world portal, including an employer profile, a candidate profile, or a Community member profile;
Registering and administering the SMART HR Community membership, including billing and collecting the Membership Fee, and providing Community benefits;
Managing the business relationship between us and a potential client/client, potential supplier/supplier, or other business partner, where you act as a collaborator, representative or contact person of that client, supplier or partner;
Operating, protecting, improving and optimising the SMART-HR.world portal and the User, Member and client experience, such as conducting analytics and research;
Transmitting messages regarding products or services purchased (cancellations, postponements or other changes regarding organised Events; updates, security alerts and account notifications);
Marketing and advertising;
Preventing, detecting or investigating fraud, security breaches and activities that are or may be prohibited or illegal, as well as defending and exercising our rights under the law;
Resolving requests from public authorities or fulfilling legal requirements (e.g. those specific to financial-accounting or tax legislation, or the prevention of money laundering).
If we intend to further process your personal data for a purpose other than the one for which it was collected, we will provide you, before that further processing, with information about the purpose of the new processing and any other relevant information you request.
4. What legal bases do we use for processing your personal data?
The legal bases for processing your data are:
Performance of a contract (Article 6(1)(b) GDPR) for purposes concerning: the creation and administration of the online user account within the SMART-HR.world portal and the transmission of security alerts and account notifications; the conclusion of sales contracts for our products (tickets, subscriptions, vouchers) and the SMART HR Community membership, including billing of the Membership Fee; the resolution of potential returns and refunds and of requests/complaints regarding purchased products or the Community membership; the transmission of messages regarding purchased products or services (cancellations, postponements or other changes regarding organised Events, updates); and the management of the business relationship between the Operator and a potential client/client, potential supplier/supplier, or other business partner, where you act as a collaborator, representative or contact person of that client, supplier or partner;
Legitimate interest (Article 6(1)(f) GDPR) for purposes consisting of: offering access to and use of SMART-HR.world portal services through its proper functioning; operating, protecting, improving and optimising the portal and the User, Member and client experience; and, within the limits described in Section 11, certain marketing and advertising activities;
Consent (Article 6(1)(a) GDPR and Article 12¹ of Law No. 506/2004) for newsletter subscriptions and other electronic direct-marketing communications sent to persons who are not existing customers, and for any other processing where consent is the basis indicated to you at the point of collection (e.g. optional profile fields, certain cookies — see the Cookie Policy);
Compliance with a legal obligation (Article 6(1)(c) GDPR) for purposes concerning accounting and tax record-keeping, the prevention and investigation of security breaches and unlawful activities, the defence and exercise of our legal rights, and resolving requests from public authorities or other legal requirements (e.g. those specific to financial-accounting, tax legislation, or the prevention of money laundering). Where we process your national personal numerical code (CNP), we do so only under the conditions set out in Article 4 of Law No. 190/2018 — i.e. based on your explicit consent, an express legal provision, or our (or a third party's) legitimate interest accompanied by adequate safeguards, including, where required by that law, the designation of a Data Protection Officer.
5. What types of data do we collect?
We collect data to operate effectively and provide you with the best experience of our services. You can make choices about the data we collect: when asked to provide personal data, you may decline. If you choose not to provide data necessary for a particular service, you may not be able to use that service.
For each processing purpose, we need certain personal data from you, as follows:
Providing access to and use of SMART-HR.world portal services: we may gather information during your visit to the portal through automated data-collection tools (cookies) — Internet Protocol (IP) address, domain name (URL), access data, browsing history on the portal (pages viewed, links clicked), HTTP response code, referring web page, volume of data transferred during the visit, and browser type and language used;
Creation and administration of the user account within the portal: first and last name, e-mail address, home locality, education data, professional skills and competencies data, phone number. Failure to provide this information will make it impossible to create a user account on our website;
Registration and administration of the SMART HR Community membership: the account data listed above, plus your Community profile information, any content you post or share within the Community, and billing details for the Membership Fee (excluding full card numbers, which are processed directly by our payment processor — see Section 7). Failure to provide this information will make it impossible to register or maintain a Community membership;
Conclusion of sales contracts for our services marketed on the SMART-HR.world portal, including order validation, delivery and invoicing, and the transmission of related messages (cancellations, postponements or other changes regarding organised Events): first name, last name, e-mail address, phone number, billing details, and the personal numerical code (CNP) — only in limited situations required by law or justified by a legitimate interest, as described in Section 4. Failure to provide this information will make it impossible to conclude a sales contract with us;
Managing the business relationship with a potential client, client, potential supplier or other business partner, where you act as a collaborator, representative or contact person: first name, last name, e-mail address, phone number, correspondence address. Failure to provide this information will make it impossible to properly perform the contract between the Company and you;
Marketing and advertising: first name, last name, e-mail address, phone number, data collected from cookies, and, where you choose to provide them, date of birth and address (county, city). Failure to provide this information will make it impossible for us to send you personalised marketing communications, such as information about products similar to those you purchased, offers and promotions, or invitations to events;
Information, order handling, resolution of returns and refunds, and resolution of requests/complaints regarding purchased products or the Community membership, including via our contact channels: the personal data necessary to resolve your specific request.
We may obtain your data directly from you, from persons acting on behalf of a client, supplier or business partner of the Operator, or from public authorities and institutions, or from publications and databases that are publicly or contractually available.
We may combine personal information we hold about you — such as your account and profile data — with information about the transactions and interactions you carry out with us on the SMART-HR.world portal, in order to provide a more consistent experience and to prevent fraud. We may also combine personal information with information we receive from other sources, such as marketing partners, public databases, publicly accessible pages on social media platforms, and other third parties.
6. Other important information
6.1. Analysing communications within/via the SMART-HR.world portal
We may review, scan or analyse communications made within the SMART-HR.world portal (e.g. sharing a page dedicated to an Event via instant messaging, social media, or e-mail) for fraud prevention, risk assessment, regulatory compliance, investigations, product development, research, analytics and customer support. For example, as part of our fraud-prevention efforts, we scan and analyse messages to mask contact information and references to other websites, and, occasionally, to debug and improve our services. We use automated methods where possible; manual review may be necessary in specific cases, such as fraud investigations or customer support. We do not review, scan or analyse your communications to send you third-party marketing messages, and we do not sell reviews or analyses of these communications.
These activities are carried out based on the Company's legitimate interest in ensuring compliance with the law and our Terms and Conditions, preventing and detecting fraud, security breaches and unlawful activities, and improving and ensuring the proper performance of our services.
6.2. Linking third-party accounts
You may be able to connect your SMART-HR.world user account with an account at a third-party social network service (e.g. Facebook). When you create this link: some of the information from the connected account may be published in your SMART-HR.world profile; your activity on the portal may be displayed to your contacts on that third-party service; a link to your public profile on the third-party service may be included in your SMART-HR.world profile; other SMART-HR.world Users may see mutual contacts you share, if applicable; the information from the connected account may be stored, processed and transmitted for fraud-prevention and risk-assessment purposes; and the display of this information is subject to your settings and authorisations on both SMART-HR.world and the third-party service.
We collect information from connected third-party accounts only to the extent necessary to perform our contract with you, to comply with applicable law, or based on your consent. If you connect a social media account to your SMART-HR.world account, the social media provider may separately share information about your use of its own services with you; please consult that provider's privacy settings to control how your information is shared.
6.3. Third-party partners and integrations
The SMART-HR.world portal may contain links to third-party websites or services, including co-branded or integrated services ("Third-Party Partners"). We do not own or control these Third-Party Partners; when you interact with them, you may provide information directly to them, to us, or to both. Third-Party Partners have their own rules regarding the collection, use and disclosure of information, and we encourage you to review their privacy policies.
Parts of the SMART-HR.world portal use third-party services, such as Google Analytics (for website analytics) and the services of our online payment processor(s), for payments made on the portal. The use of these services is subject to their own privacy policies and terms (for example, the Google Analytics terms, and the terms of our payment processor(s)) [names of the specific processors to be listed].
7. How do we use your personal data?
We may use, store and process personal information to (1) provide, understand, improve and develop the SMART-HR.world portal, (2) create and maintain a trusted and safer environment (such as compliance with legal obligations and our own policies), and (3) provide, personalise, measure and improve our advertising and marketing.
7.1. Providing, improving and developing the SMART-HR.world portal
We may use personal information to: allow you to access and use the portal (including SMART HR Event and SMART HR Community); operate, protect, improve and optimise the portal and the User, Member and client experience, including analytics and research; provide our own products and services or those of Third-Party Partners; send you messages regarding purchased products and services, updates or Event cancellations, security alerts and account notifications; and to inform you about, take, and resolve orders, returns and refunds, and requests or complaints of any kind regarding purchased products or the Community membership.
We process personal information for these purposes based on our legitimate interest in improving the portal and the experience of our Members and clients, and, where necessary, for the performance of our contract with you.
7.2. Creating and maintaining a trusted and safer environment
We may use personal information to: detect and prevent fraud, security breaches and unlawful or potentially unlawful activities, spam, abuse and other harmful activities; conduct security investigations and risk assessments; carry out database and other information-source checks, including background or police checks, to the extent permitted by law and, where required, with your consent; comply with legal obligations; resolve disputes with our Users, Members or business partners and enforce our agreements; and ensure compliance with our Terms and Conditions and other policies.
We process personal information for these purposes based on our legitimate interest in protecting the portal, on the performance of our contract with you, and on compliance with applicable law.
7.3. Providing, personalising, measuring and improving advertising and marketing
We may use personal information to: send promotional messages, marketing, advertising and other information that may be of interest to you, based on your preferences, including via social media advertising (e.g. Facebook, Google); personalise, measure and improve our advertising; administer surveys, contests or other promotional activities organised by us or Third-Party Partners; manage your newsletter subscription (this does not affect the frequency of administrative e-mails related to products or services you have purchased; promotional e-mails are free of charge; note that some promotions may only be available to Users with an online user account); and send invitations to local events, promotions and opportunities within the SMART-HR.world portal, including SMART HR Community activities.
We process your personal information for the purposes listed in this section based on our legitimate interest in marketing activities that may be relevant to you, subject to the consent and soft opt-in requirements described in Section 11 for electronic direct-marketing communications.
7.4. How our payment processor(s) use your personal information
Our payment processor(s) may use personal information, as independent controllers or as processors acting on our behalf, to: allow you to access and use payment services; detect and prevent fraud, abuse, security incidents and other harmful activities; conduct security investigations and risk assessments; carry out database and other information-source checks; comply with legal obligations (such as anti-money-laundering regulations); and enforce payment terms and other payment policies. This processing is carried out based on the payment processor's legitimate interest in improving its services, the performance of its contract with you, and compliance with applicable law.
8. How long do we store your personal data?
We store your personal data for as long as necessary to provide the purchased products and services, carry out the transactions you have requested, or for other essential purposes such as compliance with legal obligations, dispute resolution and the performance of our agreements. Actual retention periods vary depending on the type of data and the product or service concerned. The criteria used to determine retention periods include:
Maintaining and improving the performance of our products, keeping our systems secure, and maintaining appropriate business and financial records;
The period for which you have given consent, or until you inform us, in one of the ways described in this Policy, that you no longer wish us to retain the data;
For data you can access yourself, until you delete it (e.g. by deleting your account);
A shorter period where the data concerned is sensitive;
The mandatory retention period provided by law, or the period necessary for an investigation or a dispute.
Retention periods differ depending on the purpose of processing, as follows:
Providing access to and use of SMART-HR.world portal services — for the duration of your online user account;
SMART HR Community membership — for the duration of your active membership, and for a further period of up to 3 years after termination, for the purposes of dispute resolution and the defence of legal claims; billing and invoicing records related to the Membership Fee are kept for 10 years from the closing of the relevant financial year, in accordance with Romanian accounting law;
Conclusion of sales contracts for our products (tickets, subscriptions, vouchers) — for a period of 3 years; personal data contained in supporting documents underlying financial-accounting entries is kept for 10 years from the closing of the financial year in which the supporting document was issued, in accordance with accounting law; data necessary for the defence or exercise of our legal rights is kept for the applicable general limitation period;
Managing the business relationship with a potential client/client, potential supplier/supplier, or other business partner — for the duration of the contract, or for as long as required by a legal obligation;
Marketing and advertising — for the duration of your online user account and for 2 years after its closure, or until your objection to this processing is resolved; or, for newsletter subscribers, until you unsubscribe;
Processing based on your consent — until you withdraw your consent, unless the law provides for a different retention period or retention is necessary for the exercise or defence of the Operator's rights;
Information, order handling, resolution of returns and refunds, and requests/complaints of any kind — for the period needed to resolve the matter; data necessary for the defence or exercise of our legal rights is kept for the applicable general limitation period.
9. Where do we transmit/transfer your personal data?
Your personal data may be processed by other controllers, joint controllers, or processors acting on the Operator's behalf, strictly in accordance with data protection legislation:
IT service providers and other companies from whom the Operator procures services or products, which have implemented adequate protection measures, in accordance with legal requirements, to ensure compliance with their personal-data-protection obligations. Where such processors subcontract part of the processing activities, their subcontractors are subject to the same technical and organisational security obligations imposed by the GDPR and by our internal policies;
Contracting parties of the Operator acting as joint controllers, for services outsourced to them;
State authorities, based on their statutory competencies;
Social media providers, where you connect your account as described in Section 6.2 — by doing so, you authorise us to share information with that provider, subject to its own privacy policy;
Service providers who manage customer information and perform services on our behalf, such as running promotions, sending communications, or conducting surveys — these providers are not authorised to use your information for any other purpose;
Business partners with whom we collaborate to offer products, services, contests or promotions;
Public authorities or third parties, where necessary or appropriate, in good faith, to comply with the law or a valid legal request, or to protect the Operator's operations, privacy, safety, property or rights;
Electronic payment processors, for payments made on the portal — these processors do not transfer your bank details to us; for any complaint or question about a specific online payment, please contact the payment processor directly;
In the event of a sale, merger or other corporate transaction involving the Company, your personal data may be among the transferred assets, subject to the safeguards required by law.
Some of the recipients described above (in particular Google Analytics and, depending on the payment processor(s) used, certain payment services) may be located, or may process data on servers located, outside the European Economic Area (EEA), including in the United States. Where this is the case, we ensure that the transfer is covered by an appropriate safeguard recognised by the GDPR — in particular the European Commission's Standard Contractual Clauses, or, for transfers to the United States, the EU-U.S. Data Privacy Framework adequacy decision adopted by the European Commission on 10 July 2023 (valid as of the date of this Policy; we monitor its legal status and will update this Policy and our safeguards if it changes). You can request further details about these transfers and the safeguards used by contacting us as described in Section 15. 10. How do I choose what promotions I receive?
We want to communicate with you only where you have given, or give, your agreement (consent) to this.
However, where you have placed at least one order on the SMART-HR.world portal or hold an online user account with us (there being an existing contractual relationship), we may send you marketing communications about our own similar products or services, without a separate newsletter subscription, based on the "soft opt-in" exception for existing customers under Article 12¹ of Law No. 506/2004 (transposing the ePrivacy Directive) and our legitimate interest (Article 6(1)(f) GDPR). In every such communication, and at the point your data was collected, you are given a clear and free way to object to this use of your data. Marketing communications sent to persons who are not existing customers, or that concern products or services that are not similar to those you have purchased, are sent only with your prior consent.
If you prefer not to receive promotional information, such as information about special offers and Events, you can let us know by contacting our customer service as described in Section 15 ("How can you contact us?"), or by clicking the unsubscribe link included in each communication we send.
11. How do we protect children's data?
We expressly note that all personal data processing described in this Policy concerns exclusively persons who are at least 16 years old. Use of our portal by children under the age of 16 is not permitted. In the exceptional event that we become aware that we have processed the personal data of a child under 16, we will cease that processing as soon as we learn of it and take reasonable steps to delete the data. Responsibility for supervising the use of our portal by children rests with their parents or legal guardians.
12. What happens if I use different devices to visit the Site?
To provide you with a more efficient and convenient experience, you may access our portal or log into your account from multiple devices (such as a computer, laptop, or mobile device). Where you do so, we may associate you with each of these devices, and combine the information collected from them with other information you have provided us, including your account data, your transaction history, and how you use our portal and its features.
We may use this combined information to provide you with a more consistent and tailored experience across your devices, as described in this Policy, and to prevent fraud (for example, by identifying access to your account from an unrecognised device) or to provide personalised offers. 13. What other kinds of data do we collect?
Our website uses cookies and similar technologies to provide you with the best experience, analyse trends, administer the website, track usage of the website, and gather demographic information about our user base as a whole.
Cookies are small text files placed on your device to record usage and preferences. We collect certain information automatically through cookies and similar tracking technologies, such as your Internet Protocol (IP) address, browser type, Internet Service Provider (ISP), referring/exit pages, pages viewed on our site, operating system, date/time, and click patterns, in order to analyse overall trends and administer the website. Some of this information (such as your IP address) is itself personal data.
Except for cookies that are strictly necessary for the functioning of the portal, we place cookies and similar technologies only with your prior consent, given through the cookie banner displayed when you first visit the portal, in accordance with Law No. 506/2004. You can withdraw or change your consent at any time through the cookie settings available on the portal, and you can also control cookies at browser level; disabling cookies may limit certain features and functions of our website and services. 14. How is my information used for behavioural advertising, and what options do I have?
We work with third-party companies that use tracking technologies (including cookies and pixel tags) on our portal to provide personalised advertising on our behalf and on behalf of other advertisers. These companies may collect information over time about your activity on our portal and other websites, as well as your interaction with our advertising and other communications, and use this information to determine what advertisements you see on third-party sites and applications, potentially across multiple devices.

Note that, regardless of whether you opt out, these tracking technologies may still collect data and you may still see advertisements, but they will not be targeted based on the information collected through these technologies.
15. What security measures have we adopted?
We ensure that your data is processed lawfully, while implementing appropriate technical and organisational measures to protect its integrity and confidentiality, in accordance with the GDPR. The Company has implemented a personal-data security policy, and your data is processed by personnel trained accordingly, to a high standard of confidentiality.
We maintain physical, electronic, contractual and organisational safeguards to help protect the security and confidentiality of your personal information. When you enter personal information on the SMART-HR.world portal, we use encryption technology to protect it during transmission.
16. What is phishing?
"Phishing" is a scam designed to steal your personal information. If you receive an e-mail that appears to be from us requesting personal information, please do not respond. We will never ask for your password, username, credit card information, or other sensitive personal information by e-mail.
17. What links to other sites do we have?
Our portal may contain links to other websites, which may have privacy policies that differ from ours. We are not responsible for the content or practices of any linked website. We recommend that you review the privacy policy of any website you visit through our portal.
18. How do you access or change the information you have provided to us?
You can ask us to update your personal information by contacting us as described in Section 19 ("How can you contact us?"). Requests to update your personal information may take up to 30 days to process if sent by e-mail, and 6-8 weeks if sent by post.

20. What rights do you have?
Under the legislation on the protection of personal data, you benefit from the following rights:
Right to be informed: to receive information about the data-processing operations we carry out;
Right of access: to obtain confirmation as to whether we process your personal data and, if so, to access that data and receive information about the processing;
Right to rectification: to obtain, without undue delay, the rectification of inaccurate personal data concerning you, or the completion of incomplete personal data;
Right to erasure ("right to be forgotten"): without undue delay, where: (1) the data is no longer necessary for the purposes for which it was collected; (2) you withdraw your consent and there is no other legal ground for the processing; (3) you object to the processing and there are no overriding legitimate grounds; (4) the data has been unlawfully processed; or (5) erasure is required to comply with a legal obligation;
Right to restriction of processing: where (1) you contest the accuracy of the data; (2) the processing is unlawful and you oppose erasure, requesting restriction instead; (3) we no longer need the data, but you need it for the establishment, exercise or defence of a legal claim; or (4) you have objected to the processing, pending verification. We will inform you before any restriction is lifted;
Right to data portability: to receive the personal data you have provided to us in a structured, commonly used, machine-readable format, and to transmit it to another controller, where technically feasible — available only where the processing is based on your consent or on a contract, and is carried out by automated means;
Right to object: to object, on grounds relating to your particular situation, to the processing of your personal data based on our legitimate interest, including profiling based on that interest; where you object to direct-marketing processing, we will stop it without needing to assess your particular situation;
Right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you;
Right to withdraw consent at any time, without giving any reason, without affecting the lawfulness of processing carried out before the withdrawal.
21. How to exercise your rights and contact details
